These Terms of Service govern your access to and use of FPSpilot (fpspilot.com). Accessing or using the site constitutes full acceptance of these terms. If you do not agree, please leave the site.

1. Description of service

FPSpilot is a gaming hardware community platform that allows users to:

• Create and publish hardware builds with component lists, estimated prices and purchase links.
• Browse information about hardware (CPUs, GPUs, gaming laptops, peripherals) with comparative performance data.
• View video game system requirements and real-world performance data contributed by the community.
• Access price comparisons and deals at external stores via affiliate links.

FPSpilot is free to use. The service is funded through affiliate commissions. See our Affiliate Disclosure.

2. Your account

2.1 Requirements

You must be at least 14 years old to register. If you are under 18, you need the consent of a parent or legal guardian. By registering, you declare that you meet these requirements.

2.2 User responsibilities

• You are responsible for keeping your password confidential and for all activities carried out under your account.
• You must immediately notify us of any unauthorised use of your account at legal@fpspilot.com.
• You may not transfer or assign your account to any other person.
• You must provide accurate information when registering and keep it up to date.

2.3 Suspension and deletion

You may delete your account at any time from your profile settings. FPSpilot may suspend or delete accounts that violate these terms, without prior notice in serious cases (spam, fraud, illegal content).

3. User-generated content

3.1 Your responsibility

You are solely responsible for the content you publish (builds, names, descriptions, images, performance data). By publishing on FPSpilot, you declare that:

• You hold the necessary rights to such content or have the rights holders' authorisation.
• The content does not infringe third-party intellectual property, industrial property or image rights.
• The content is not false, misleading, offensive, defamatory, illegal or contrary to public order.

3.2 Licence to FPSpilot

By publishing content, you grant FPSpilot a non-exclusive, royalty-free, worldwide, sublicensable licence to store, reproduce, display and distribute such content within the service and for the purpose of promoting the service (e.g. site screenshots on social media).

3.3 Prohibited content

You may not publish:

• Content that infringes third-party intellectual property rights.
• Personal data of third parties without their consent.
• False or misleading content: fabricated builds, invented performance data, manipulated prices.
• Offensive, discriminatory, harassing, violent or sexually explicit content.
• Spam, unauthorised advertising, phishing links or malware.
• Content impersonating another person or organisation.

3.4 Moderation

FPSpilot may remove any content that, in its reasonable judgement, violates these terms or applicable law, without prior notice unless required by law. Affected users may contact legal@fpspilot.com to request a review.

4. Intellectual property

All platform elements created by FPSpilot (design, code, logos, original texts) are protected by intellectual property rights. You may not copy, reproduce or reuse them without express authorisation. Linking to public pages of the site is permitted.

5. Performance data and accuracy

Performance data (FPS, comparative hardware scores) are relative estimates for informational purposes. They do not constitute a guarantee of the FPS you will achieve; actual results depend on your specific configuration, drivers, game settings and many other factors. Prices shown are approximate, user-submitted, and may not match current store prices.

The "verified creator" badge indicates only that FPSpilot has verified the identity of that account holder; it does not imply that their builds or data have been audited or warranted by FPSpilot.

6. Disclaimer for external purchases

FPSpilot does not sell products. Purchase links direct users to independent external stores. FPSpilot is not a party to any transaction, and accepts no liability for products purchased, their quality, warranty, availability or any dispute between the user and the store. Any claim must be directed to the retailer.

7. Limitation of liability

To the extent permitted by applicable law:

• FPSpilot will not be liable for indirect, incidental, special, punitive or consequential damages arising from or in connection with the use or inability to use the service.
• FPSpilot's total liability to any user, for any cause, will not exceed the amounts the user has paid to FPSpilot in the preceding twelve months (which, as the service is free, is zero euros, unless applicable mandatory law provides otherwise).

This limitation does not affect non-waivable consumer rights under Spanish and European law.

8. Service availability

FPSpilot endeavours to keep the service available, but does not guarantee uninterrupted availability. We may suspend the service for maintenance, updates or force majeure. We will not be liable for any resulting interruptions.

9. Modifications to the service and terms

FPSpilot may modify, extend or discontinue any service feature at any time. We may also update these Terms; material changes will be notified by email or via a site notice. Continued use after publication of new terms constitutes acceptance.

10. Governing law and jurisdiction

These Terms are governed by Spanish law. For any dispute, the parties submit to the competent courts in accordance with Spanish consumer protection regulations, without prejudice to the user's right to resort to their local courts if permitted by law.
